These Terms of Service (“Terms”) govern your use of Benefaster (“Service”), operated by Solvative LLC (“we,” “us,” or “our”), a Limited Liability Company formed in Texas, United States.

This is a business-to-business (B2B) service. By accessing or using the Service, you confirm that you are acting on behalf of a business or community organization and have the authority to bind that entity to these Terms. If you do not agree, do not use the Service.

2. What the Service Does

Benefaster is a community management platform that consolidates multiple disconnected tools into a single solution. The Service includes member management, event management, donation tracking, analytics, and communications tools designed to help associations, alumni networks, and community organizations manage their members and operations more efficiently.

The Service does not modify your data in any unauthorized way. All data you input into the platform remains your property and is processed solely to provide the features and functionality described herein.

You retain full ownership of your organizational data and community member information at all times. We acquire no rights to your data beyond what is necessary to operate the Service.

The Service may integrate with third-party platforms including payment processors, email service providers, and CRM tools. Your use of those integrations is governed by the respective terms of service and privacy policies of those platforms. We are not responsible for:

10. Disclaimer of Warranties

The Service is provided “as is” and “as available.” We do not make any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Service will be error-free or uninterrupted under all conditions. We will make commercially reasonable efforts to maintain reliability and notify you of known issues promptly.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Solvative will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such losses.

Our total aggregate liability to you for any claims arising under these Terms will not exceed the greater of (a) the total fees you paid to us in the six months before the claim arose, or (b) USD $500. This cap does not apply to liability for gross negligence, willful misconduct, or breach of confidentiality obligations.

12. Suspension and Termination

You may stop using the Service at any time. To formally close your account and request deletion of your data, contact us at legal@solvative.com. We will confirm receipt and complete account deletion within 30 days.

14. Governing Law and Disputes

If a dispute arises, both parties agree to first attempt resolution through good-faith negotiation for at least 30 days before initiating formal proceedings. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts of Dallas, Texas, United States.
